Update on the Mid-America Milling Federal Court Case Challenging the DBE Program

On March 19, 2026, the federal judge dismissed the Mid-America Milling case challenging the DBE Program. The ruling stated that:

  • The Intervenor DBEs’ Motion to Dismiss and Vacate is granted.
  • The September 24, 2024, Preliminary Injunction is dissolved.
  • The Parties’ Joint Motion for Entry of a Consent Order is denied as moot.

The judge did not rule on the merits of the case, but cited jurisdictional limitations, noting the matter has become moot following USDOT's issuance of the Interim Final Rule in October 2025. The Interim Final Rule remains in effect. The decision is attached for your reference.
